Below is the �Action Summary Report� from the Board of Supervisor�s meeting of July 6th & 7th. Next Monday night at 6:00 will be the next BOS Public Hearing and following that will be a special meeting to discuss and possibly vote on the Kincora application.

Families are needed to host players in the 2010 14-year-old Babe Ruth World Series that takes place August 21-28 in Purcellville. Approximately 130 boys need to be housed beginning August 19. Currently, approximately 25 additional host families are needed. Participating families receive personal support from the Host Family Chairman, as well as family passes for the tournament, parking passes, and banquet tickets. Families interested in hosting players from one of the eight regional teams for the week of the tournament can contact Joe Robillard at president@glbr.org or 703-282-7410.

There is one last issue I would like to discuss with you. It involves Mandatory Federal Collective Bargaining. I am writing to you concerning the recent U.S. House of Representatives� July 1st approval of mandatory collective bargaining for all public safety personnel. This proposal was added to an $80 billion appropriations bill funding the wars in Iraq and Afghanistan. The Senate will act soon on this legislation.

The mandate, if enacted, will require localities such as Loudoun County to collectively bargain with public safety labor unions over wages, benefits and working conditions. This legislation forces states and localities such as Loudoun County to adopt these standards and disregards existing Virginia state law and ordinances that were developed to create an effective and efficient public sector workforce, and places the needs of a select group of workers-public sector officers in front of the larger needs of the community and other public sector employees including teachers. Please keep in mind that a significant number of Virginia�s public safety personnel currently receive enhanced benefits. These current benefits have been granted by the Commonwealth and in some cases by local governing bodies without any federal mandate.

The Board of Supervisors takes great pride in the county�s law enforcement and fire and rescue services and fully appreciates the 800 dedicated and professional public safety employees who serve our community. That is why, even in this historic economic recession with decreasing public revenues, the county had attempted to maintain its share of public safety funding. This mandate will impose significant pressures on the county budget over time.

The Loudoun County Board of Supervisors remains opposed to this legislation and remains committed to providing our public safety workers with excellent working conditions, competitive salaries, excellent health and pension benefits and a working environment that is safe and appropriate for our community. Loudoun County is not alone in its opposition to this legislation. Diverse interests such as the National Sheriff�s Association, the International Association of Chiefs of Police, the International Public Management Association for Human Resources, the National and Virginia Association of Counties, the International City County Managers Association, the United States and Virginia Chambers of Commerce also oppose this legislation as do others.

The Senate is scheduled to return to Session July 12, 2010 and is likely to take up this legislation during the week. Please take the time to urge both Senators Webb and Warner to oppose this expensive mandate included in H.R. 4899, the supplemental appropriation act.

discussion and consideration of the acquisition of real property for public use, where discussion in open session would adversely affect the bargaining position or negotiating strategy of the Board. The subject of the closed session is acquisition of improved real property for government office use.

The Board of Supervisors moved to approve BA#110042 transferring $700,000.00 to VDOT for the preliminary engineering of the Route 606 Dulles Loop Project, and that the funds be transferred from a transportation cash contribution from a preliminary subdivision plan (SBPL-1987-0027, Mercure) to a property located along the Route 606 corridor for inclusion of the Dulles Loop Project in the Commonwealth Transportation Board�s adopted Six-Year Program as described in the July 7, 2010 Administrative Items Report.

e. DEPARTMENT OF MENTAL HEALTH, SUBSTANCE ABUSE, AND DEVELOPMENTAL SERVICE FY11 STATE PERFORMANCE CONTRACT:

The Board of Supervisors moved to approve the FY11 State Performance Contract as presented in the July 7, 2010 Administrative Items Report.

f. TIMELINE EXTENSION FOR CMPT 2009-0011 ARCOLA SUBSTATION:

The Board of Supervisors moved to approve a timeline extension to October 31, 2010 for Planning Commission action on CMPT 2009-0011, Arcola Substation.

g. REQUEST FOR TRAFFIC CALMING MEASURES/SOUTH VILLAGE DRIVE AND LAURIER DRIVE/DULLES DISTRICT:

The Board of Supervisors moved to request VDOT to install �$200 Additional Fine for Speeding� signs along the residential street of South Village Drive which has already been accepted into the State System for maintenance.

The Board of Supervisors further moved to request VDOT to accept into their State System for maintenance the developer revision to their pavement markings and signage plan for the addition of a �speed limit sign� and a �$200 Additional Fine for Speeding: sign along the residential street of Laurier Drive.

h. CHANGE IN START TIME FOR REGULARLY SCHEDULED JULY PUBLIC HEARING:

The Board of Supervisors moved to confirm the scheduling of a public hearing to be held in the Board Room in Leesburg, VA, on July 12, 2010, beginning at 6:00 p.m. and that the items to be heard at that time and place are those properly scheduled and advertised for the July 12, 2010 Public Hearing.

i. COUNTY ACQUISITION/VARIOUS EASEMENTS FOR CONSTRUCTION OF THE ROUTE 7/ROUTE 607 INTERCHANGE (ESMT 2009-0052) (DULLES OVERLOOK, LLC):

The Board of Supervisors moved to authorize the Chairman, or in his absence the Vice-Chairman or County Administrator, to indicate the County�s acceptance of the easements by executing an appropriate Deed approved as to form by the County Attorney by which Dulles Overlook LLC grants to the County and to LCSA easements for the construction of the Route 7/Route 607 Interchange.

j. PURCHASE OF AFFORDABLE DWELLING UNIT (ADU)/23098 MINERVA DRIVE, BRAMBLETON, VIRGINIA:

The Board of Supervisors moved to authorize staff to bid up to $136,008.00 to purchase the property at 23098 Minerva Drive, Brambleton, Virginia 20147; and that the Chairman of the Board of Supervisors, the Vice Chair, the County Administrator or his designee be authorized to accept the Deed to the property pursuant to Virginia Code �15.2-1803. Said deed shall be approved as to legal form by the County Attorney, who shall be authorized to execute any collateral documents required at closing for the purchase or for the resale of the unit.

k. REQUEST FOR THE BOARD OF SUPERVISORS� APPROVAL OF

REGULAR, FULL-TIME POSITION FOR THE DEPARTMENT OF MENTAL HEALTH, SUBSTANCE ABUSE AND DEVELOPMENTAL SERVICES: PEER SPECIALIST POSITION (1.00 FTE) FOR THE VIRGINIA WOUNDED WARRIOR PROGRAM � NORTHERN REGION GRANT AND APPROVAL OF BUDGET ADJUSTMENT #110035 FOR FY2011 :

The Board of Supervisors moved approval of the regular, full-time Peer Specialist Position (1.00 FTE) and approval of Budget Adjustment #110035 for the Department of Mental Health, Substance Abuse and Developmental Services.

l. MUTUAL FIREFIGHTING AND RESCUE ASSISTANCE AGREEMENT BETWEEN LOUDOUN COUNTY, VIRGINIA AND FREDERICK COUNTY, MARYLAND:

The Board of Supervisors moved approval of the Mutual Aid Response Agreement between Loudoun County, Virginia and Frederick County, Maryland.

m. CERTIFICATION OF DESIGNATED PLANS EXAMINERS (DPE):

The Board of Supervisors moved approval of the recommendation of Christopher William Myers, Katalin Barczay, and Abbas Abedi-Jafari as Designated Plans Examiners at its July 7, 2010 business meeting.

n. REQUEST FOR THE BOARD OF SUPERVISORS� APPROVAL OF

POSITION FOR THE OFFICE OF TRANSPORTATION SERVICES: SENIOR TRANSPORTATION PLANNER POSITION (.077 FTE):

The Board of Supervisors moved to approve the creation of a regular, part-time Senior Transportation Planner Position (0.77 FTE) for the Office of Transportation Services.

3. CMPT 2010-0002, SPEX 2009-0041, SPMI 2010-0001, POTOMAC INTERCEPTOR ODOR ABATEMENT SITE:

Vice Chairman Buckley moved that the Board of Supervisors ratify the Planning Commission decision to approve CMPT 2010-0002, Potomac Interceptor Odor Abatement Site.

Vice Chairman Buckley moved that the Board of Supervisors approve SPEX 2009-0041 and SPMI 2010-0001, Potomac Interceptor Odor Abatement Site, subject to the Conditions of Approval dated June 24, 2010, and based on the Findings attached to the July 7, 2010, staff memorandum. (Consent Item) (Seconded by Supervisor Wasters. The motion passed 7-0-2, Supervisors Burton and Kurtz absent for the vote.)

4. ZMOD 2008-0017,BELMONT EXECUTIVE CENTER COMPREHENSIVE SIGN PLAN:

Supervisor Waters moved that the Board of Supervisors approve ZMOD 2008-0017, Belmont Executive Center Comprehensive Sign Plan subject to the Conditions of Approval dated June 23, 2010 and with the Findings. (Seconded by Chairman York. The motion passed 7-1-1, Supervisor Kurtz voted no and Supervisor Burton absent. )

5. CMPT 2009-0012, TOWN OF LEESBURG LOWER SYCOLIN PUMP STATION:

Vice Chairman Buckley moved that the Board of Supervisors ratify the Planning Commission decision to approve CMPT 2009-0012, Town of Leesburg Lower Sycolin Pump Station, subject to the Commission Permit Plat dated October 6, 2009, revised through April 7, 2010, and based on the findings. (Consent Item) (Seconded by Supervisor Waters. The motion passed 7-0-2, Supervisors Burton and Kurtz absent for the vote.)

6. proposed loudoun heritage farm museum MANAGEMENT AGREEMENT and reduction in force:

Vice Chairman Buckley moved that the Board of Supervisors vote to approve the Management Agreement for the Loudoun Heritage Farm Museum.

Vice Chairman Buckley moved that the Board of Supervisors eliminate 2.84 FTE�s from the Loudoun Heritage Farm Museum and enact the County�s Reduction in Force Policy with respect to these positions.

Vice Chairman Buckley further moved for approval of BA#110037, moving funds from PRCS to Regional Organizations in order to provide funding to the Board of the LHFM. (Consent Item) (Seconded by Supervisor Waters. The motion passed 7-0-2, Supervisors Burton and Kurtz absent for the vote.)

7a. FINANCE/GOVERNMENTSERVICESAND OPERATIONS COMMITTEE REPORT/CONTRACT RENEWAL/COMPANION SERVICES:

Vice Chairman Buckley moved that the Board of Supervisors recommend the Finance/Government Services and Operations Committee to authorize the Purchasing Agent to renew the Companion Services contract with The Medical Team in the estimated amount of $1,012,427 for the period of August 1, 2010 through July 31, 2011. 7b. finance/governmentservicesand operations committee report: consideration of a 2010 bond referendum and/or a virginia public school authority (VPSA) participation followed by the future sale of $27,820,000 in general obligation bonds to finance capital projects included in the adopted fiscal year 2011-2016 capital budget:

Vice Chairman Buckley moved that the Board of Supervisors approve the recommendation of the Finance/Government Services and Operations Committee to adopt the resolution (Attachment II) entitled �Resolution of the Board of Supervisors of the County of Loudoun, Virginia, Requesting the Circuit Court to Order a Special Election on November 2, 2010, on the Question of Issuing Not to Exceed $27,820,000 in General Obligation Bonds to Finance Public Improvements�. (Consent Item) (Seconded by Supervisor Waters. The motion passed 7-0-2, Supervisors Burton and Kurtz absent for the vote.)

7c. FINANCE/GOVERNMENTSERVICESAND OPERATIONS COMMITTEE REPORT/CONTRACT EXTENSION AND HEALTH PLAN UPDATE FOR COUNTY-WIDE GROUP HEALTH PLAN/MEDICAL, PRESCRIPTION DRUGS, DENTAL AND VISION:

Vice Chairman Buckley moved that the Board of Supervisors approve the recommendation of the Finance/Government Services and Operations Committee to authorize the Purchasing Agent extend the group health plan contracts with CIGNA HealthCare, Delta Dental of Virginia, and Davis Vision for third-party administrative services as stipulated herein through December 31, 2010 and adopt the existing premium rates as shown in Attachments I, II, III, and IV. Vice Chairman Buckley further moved that the Finance/Government Services and Operations Committee recommend that the Board of Supervisors authorize the County Administrator through the Director of General Services to enter into any funded leases during the August recess that cannot be delayed until the September 2010 Finance/Government Services and Operations Committee meeting. Vice Chairman Buckley moved that the Board of Supervisors approve the recommendation of the Finance/Government Services and Operations Committee to approve the use of Housing Funds to purchase and rehabilitate properties within any HUD-approved NSP census tract (including Leesburg) and that $148,750 in Housing Funds be distributed to Loudoun Habitat for the purchase and rehabilitation of a minimum of three properties. Below is the �Action Summary Report� from the Board of Supervisor�s meeting of June 14th and 15th. Because of the upcoming 4th of July holiday, the next Board meetings will be on the evening of Tuesday, July 6 and during the day, Wednesday, July 7.

I want to thank the 100 plus speakers who came out to speak during Public Input. They primarily spoke concerning the Countywide Transportation Plan (CTP), Chesapeake Bay Ordinance (CBPO), and the Whites Ford Park application. On Tuesday the 15th, the CTP was adopted but there is now some discussion of calling a special meeting of the Board to reopen it. This will be most unfortunate as three Board members, including myself, will be gone either on business trips or in one case, a family vacation.

While there are many good things in the CTP and much compromise was made over certain issues, I felt that there was one major mistake being made to the plan that I simply could not support. Unfortunately, in my humble opinion, the Board went too far in reducing the planned Rt. 659 which will be relocated in the future, south of Rt. 50, from a six lane road to keeping it as a two lane road south of Braddock Road. This transportation route has been long viewed as a major connection to Prince William County�s Rt. 234 which is a 4 lane facility. I feel that we should continue to plan it as a 4 lane road. This would provide significant relief to Rt. 15 and help to add to the future capacity needed in a part of the county that will continue to see significant growth.

So why is it important for us to have a CTP and show the road facilities on a map? As the county grows and developers come in with proposed projects, whether by-right or through a rezoning, we are able to request that the land required for future road projects that are on the CTP be put into an easement so when a road project is funded, we the taxpayers will not have to pick up the cost of acquiring the rights-of-way. Just as an example, the improvements to Rt. 28 cost around $250 million. Of that $250 million, it cost $53.6 million for the rights-of-way that were not in easements dedicated for the road project.

Some happenings around the County: This Saturday is Youth Fest at Brambleton Town Center from 2pm-8pm. This free, day-long event for teens features live music, interactive video games, spray tattoo booths, a rock wall, exhibits, prizes, and a Star Recording Studio where kids can record their own CD. In addition, all finalists in the 2009-2010 Loudoun All Star Battle of the Bands will perform during YouthFest. Festival headliner, My Favorite Highway, is expected to take the stage at 7:00 p.m. following a performance by the winner of the Battle of the Bands, Mercury in Summer.

The Department of Construction and Waste Management will host a Household Hazardous Waste Event on Saturday, June 26 at Stone Bridge High School, 43100 Hay Road, Ashburn. The event is from 8:30 a.m. to 2:30 p.m. and is for Loudoun County Residents only. Visit www.loudoun.gov/hhw to learn more about items accepted/not accepted at the event and to find the complete 2010 schedule.

Please look out for your neighbors on these horrible hot days. The Virginia Department of Aging, Loudoun County Area Agency on Aging and Dominion Virginia Power are sponsoring a Fan Care Program for eligible persons age 60 and over. Applicants must demonstrate need based on income criteria. A portion of available funds may be used to purchase window air conditioners. The program runs through September 30 and you may call 703-777-0257 for more information.

In conclusion, I wish all of you a happy 4th of July! There are several events locally to enjoy that weekend with many firework displays on the evenings of the 3rd and 4th.

1. SIGNATURES OF LOUDOUN DESIGN EXCELLENCE AWARDS:

Alan Hanson, members of the Design Cabinet and Board members presented the following Award Winners, Award Owners, and Design Award Categories for 2010:

1. Supervisor Burk presented the South King Street Center(Barrett Companies) the Familiar Award. This category features design excellence demonstrated in the attention given to surrounding buildings, places and details during the project design. A highly contextual design solution in which the new project looks as if it had always been a visually harmonious member of the larger family of forms, textures, and colors found in the neighborhood.

2. Supervisor Waters presented the A.V. Symington Aquatic Center and Ida Lee Recreation Center(Town of Leesburg) the Mixing Places award. This design excellence demonstrated in the form of public greens, plazas and squares, which, by their organization and attributes, are a favorite place for people of all ages to hang out.

3. Supervisor McGimsey presented the Foxridge Park(Town of Leesburg) the Details award. This design excellence or whimsy demonstrated in the form of minutiae or finishing touches, which visually delight or offer a sense of continuity with Loudoun�s history.

4. Chairman York presented the George C. Marshall Statue(George Marshall International Center) the Details award. This design excellence or whimsy demonstrated in the form of minutiae or finishing touches, which visually delight or offer a sense of continuity with Loudoun�s history.

5. Supervisor Buckley presented the Shoes Cup & Cork Club (Ed Shihadeh, Richard Ellis, SWaN Investors) the Makeovers award. This design excellence demonstrated in the form of historic renovation and/or adaptive reuse. These projects may mirror Loudoun�s unfolding reputation as a place of rich contrasts.

6. Supervisor Kurtz presented the Burnett Residence(Peter Burnett) the second recipient of the Makeovers award.

7. Supervisor Miller presented the AOL Creative Center II(AOL) the Pace Setters and Students� Choice Award. This design excellence demonstrated visually groundbreaking projects which continue to shape Loudoun County as a unique environment. While Loudoun�s local vernacular buildings, places and details mark the community�s beginnings, these projects mark its current state of affairs. PACESETTERS may well be the LEGENDS which the Design Excellence Program honors a quarter century from now. The Students� Choice award was selected by a panel Loudoun County high school students as best representing design excellence in Loudoun County.

8. Supervisor Delgaudio presented the Charles Luck Studio(Charles Luck), the second Pace Setters award.

9. Supervisor Burton presented the Hillsboro Old Stone School(Mayor Vance, HCA President Mark Ware) the Legends award. This recognition for design excellence over a period of 25 years or more, withstanding a �test of time.�

Supervisor Burton moved that the Board of Supervisors adopt the proposal by the Ad Advisory Committee for new criteria for approving parcels in Ag and Forestal Districts as a one-year pilot program. (Seconded by Supervisor Kurtz.) (This motion did not receive a vote.)

Supervisor Delgaudio moved a substitute motion that the minimum qualifying acreage for the Open Space category of Land Use Program for properties qualifying for a deferral based on their inclusion in an Agricultural and Forestal District be increased from 5 acres to 20 acres. The minimum requirement shall apply to new applications/agreements and to existing Open Space agreements as their Land Use assessment applications require recertification.

Supervisor Delgaudio further moved that the Board of Supervisors direct staff to prepare an amendment to the Codified Ordinances of Loudoun County, to develop an advertisement for publication for no later than the Board�s July 12, 2010 public hearing, and to prepare the necessary action items. Supervisor Delgaudio accepted Chairman York�s friendly amendment that this item be included on the Board�s September 13, 2010 public hearing.

11. Transportation and Land Use Committee Report/

FINAL REPORT/STERLING AREA PROACTIVE ENFORCEMENT:

Supervisor Burton moved that the Board of Supervisors direct staff to continue the Sterling area proactive Zoning and Virginia Maintenance Code inspection effort after June 30, 2010 within normal working hours.

Supervisor Burton further moved that staff return to the Transportation Land Use Committee in early 2011 with detailed activity reports for the prior months reporting period and updates on the programs progress. (Consent Item) (Seconded by Supervisor Burk. The motion passed 9-0.)

12. DULLES ROUTE 7/28 FIRE STATION PPEA PROPOSALS:

Chairman York moved that the Board of Supervisor forward Dulles Route 7/28 Fire Station PPEA Proposals to the to the July 12, 2010 Special Meeting to follow the Board�s July 12th Public Hearing and to be heard following the Kincora Village. (Seconded by Supervisor Waters.)

Chairman York accepted Supervisor Waters� friendly amendment that the Board of Supervisors signal an intent to encumber the remaining voter approved Bond Funds for the Route 28 Fire Station.

13. SPEX 2010-0005, HAMILTON WELL 14, STONE EDEN PROPERTY:

Supervisor Burton moved that the Board of Supervisors approve SPEX 2010-0005, Hamilton Well 14, Stone Eden Property, based on the Findings in the staff report and the Conditions of Approval dated June 15, 2010, and the Revised Pumping, Monitoring and Mitigation Plan Addendum dated June 15, 2010 for the Town of Hamilton Well 14 dated October 15, 2007, and including the modification of the Type Two (2) buffer yard and screening adjacent to residential lots to eliminate such landscaping along the front, side and rear yards and amended to remove Condition #6 and striking the words �at its cost� on Attachment 4, Monitoring Data for Projected Town Needs. (Seconded by Chairman York. This motion did not receive a vote.)

Supervisor Miller moved a substitute motion that the Board of Supervisors defer SPEX 2010-0005, Hamilton Well 14, Stone Eden Property, to the Board of Supervisors� July 20, 2010 Business Meeting to allow the Hamilton Town Council additional time for review. (Seconded by Supervisor Burk. The motion passed 8-0-1, Vice Chairman Buckley absent for the vote.)

14. CPAM 2005-0009, REVISED COUNTYWIDE TRANSPORTATION PLAN UPDATE:

Supervisor Burk moved that the Board of Supervisors approve and adopt CPAM 2005-0009 Revised Countywide Transportation Plan Update, as amended with recommendations from the Transportation and Land Use Committee as shown in the June 15, 2010 staff report, and as further amended by the Board of Supervisors at the June 15, 2010 Business Meeting. (Seconded by Supervisor Kurtz.)

Chairman York moved that the Board of Supervisors amend Page 2, Bullet 5, of the staff report, �Show an ultimate condition of the 2 lanes for Northstar Boulevard south of Braddock Road� to read �Show 4 lanes in a 120-foot right of way for Northstar Boulevard south of Braddock Road.� (Seconded by Supervisor Delgaudio. The motion FAILED 4-5, Supervisors Burk, Burton, Kurtz, McGimsey and Miller voted no.)

The Board concurred with Supervisor McGimsey�s request that staff to hold a Potomac District meeting and an additional meeting with the residents of Broad Run Farms.

Supervisor Burton moved that the Board of Supervisors forward ZOAM 2009-0004, DOAM 2009-0004/Proposed Chapter 1222 of the Codified Ordinances of Loudoun County and Amendments to Chapters 1066 and 1220 of the Codified Ordinances of Loudoun County to a Committee of the Whole at the second Business Meeting in September for review and that staff continue public outreach through meetings with each Board member (as requested) in each election district and through other communication efforts. There is a lot happening in Loudoun County every week and I�d like to share a few of those items with you.

Loudoun County residents are cordially invited to attend the new Eastern Loudoun Sheriff�s Station located at 46620 East Frederick Drive in Sterling. The dedication ceremony will be held today at 6:30 p.m., Wednesday, June 9, 2010. Members of the community are invited to an open house and to take a self-guided tour of the facility following the ceremony.

The Babe Ruth World Series Committee will hold auditions for local singers interested in performing the National Anthem at the 14-Year-Old Babe Ruth World Series scheduled for August 21-28, 2010 at Firemans Field in Purcellville, Virginia. Auditions will be held July 6-7 between 6:00 p.m. and 8:00 p.m. at Loudoun Valley Community Center located at 320 W. School Street, Purcellville, VA 20132. Interested singers are asked to call 703-777-0319 to schedule an appointment. Singers should be prepared to perform acappella (without instrumental accompaniment).

The new Tysons Express Bus Service from Loudoun to Tysons Corner will begin operating Monday, June 21, 2010.

The new service will help commuters avoid traffic congestion during the construction of Metrorail to Dulles and the I-495 Capital Beltway High Occupancy Toll lanes. Construction of both projects comes together in Tysons Corner.

The Tysons Express Loudoun service includes four new commuter coach buses with free WiFi. Highlights of the new service include:

� Seven morning and seven evening trips each weekday between Loudoun and Tysons Corner

� Morning pickups begin at the Leesburg Park and Ride Lot on Sycolin Road at 5:39 a.m. and the last bus leaves the Broadlands South Park and Ride Lots at 8:36 a.m.

� Afternoon and evening pickups at 18 stops in Tysons Corner, including major employment sites, occur between 3:30 p.m. and 6:51 p.m.

� Bus fare is $3 one-way with a SmarTrip card or $3.50 one-way, paying with cash

The buses will travel on the Dulles Greenway and the Dulles Airport Access Road for a scheduled 45-minute ride from Leesburg to the first bus stop in Tysons Corner. Once in Tysons, commuters can take advantage of the free Tysons Connector shuttle service. The Tysons Connector makes stops at major employers, retailers and businesses every ten minutes between 10:00 a.m. and 2:30 p.m. weekdays.

The Loudoun to Tysons Express Bus Service is managed by the Loudoun County Office of Transportation Services and funded by the Metropolitan Washington Airports Authority�s Dulles Corridor Metrorail Project. More information on the Loudoun to Tysons Express service, including schedules and route information, is online at www.loudoun.gov/bus-tysons.

A community input session on development strategies for the Route 28 corridor will be held Monday, June 21, 2010, from 6: 30 p.m. to 8: 30 p.m., at Loudoun Water, located off Loudoun County Parkway, at 44865 Loudoun Water Way in Ashburn.

County staff will make a presentation on draft strategies related to development within the Route 28 corridor that modify the existing Keynote Employment policies while emphasizing the importance of Route 28 as a major planned employment corridor. 1a. BRIEFING ON JUNE PUBLIC HEARING :

The Board accepted, as presented, information on land use applications scheduled for the June 7, 2010 Public Hearing and projected cases expected for the July Public Hearing that was included in the Board�s June 7th Board Public Hearing meeting packet.

1b. Demographic Forecasts Used for Countywide Transportation Plan Modeling: Staff gave a presentation about the demographic data used as part of the proposed Countywide Transportation Plan and the extent the data used for the proposed Plan and how it differed from build out.

2. Presentation /Greater Loudoun Babe Ruth World Series

The Greater Loudoun Lions (14U Babe Ruth World Series Team) will serve as host for the 2010 14-Year-Old Babe Ruth World Series, which will be played August 21-28, 2010 at Fireman�s Field in Purcellville, VA. Mike Stup, Team Manager, introduced the 2010 team members that would be participating in the tournament.

Report of the June 2, 2010 Board of Supervisors� Business Meeting

- BRIEFING BY KEITH BROWER, INTERIM FIRE CHIEF ON SIGNIFICANT INCIDENT REPORTS: Keith Brower, Interim Fire Chief, provided the Board a briefing on the Significant Incident Reports.

Supervisor Burton requested that Interim Chief Brower schedule a meeting with his office on these issues.

Supervisor Delgaudio asked that Interim Chief Brower provide further information on the public safety issue of large unorganized gatherings.

Chairman York added that educating the churches and other organizations on the public safety aspect of large gatherings could be helpful.

- ADOPTION OF THE CONSENT AGENDA: Supervisor Miller moved to approve adoption of the Consent Agenda. (Seconded by Supervisor Burk. The motion passed 9-0.) The following thirteen items were approved by consent: #4, #5, #6, #7, #10a, #10b, #10c, #10d, #10e, #10f, #10g, #12, and #13.

1a. Welcome First Graders from Lincoln Elementary School

Board members welcomed the first graders from Lincoln Elementary School. The first grade students at Lincoln Elementary School visited Leesburg on Tuesday, June 1, 2010, as the culminating activity of their economic unit. This was the twelfth year that the Lincoln Elementary first graders have visited Leesburg. This year, the class named their town Whale Wind Island. The students used direct democracy to elect Mayor Laurel Wedemeyer, Vice Mayor Gianna Julio, and the Town Council: Madeline Ackman, Madeleine Nordahl, Ellery White and Sofie Bogucki. Due to the Board of Supervisors meeting not coinciding with the first grade student�s field trip on June 1st. Madeline Ackman, Ellery White, Sofie Bogucki, and Madeleine Nordahl from the Town of Whale Wind Island presented their letters to the Board at the June 2nd Business Meeting.

1b. Dulles Metrorail capital construction cost and annual operations & maintenance expenditures :

Tom Farley, Office of Transportation Services, updated the Board on the Dulles Corridor Metrorail Project.

2. School Board Action: High School Assessment Studies:

Paul Brown, Office of Capital Construction, made a brief presentation on the School Board�s Action regarding High School Assessment Studies. He commented on the action taken by the Loudoun County School Board at its May 25, 2010 business meeting regarding the high school assessment studies. He noted at the April 20, 2010 Business Meeting, the Board of Supervisors approved the transfer of $280,000 from the County Capital Fund to the School Capital Fund to fund architectural and engineering assessments at four School Board owned high school sites to determine their maximum expansion potential. This included the potential to consider expansions up to and beyond 2,000 students. The four high schools to be studied are Tuscarora High School, Stone Bridge High School, Broad Run High School, and Briar Woods High School. The Loudoun County School Board Chairman�s January 20, 2010 letter to the Board of Supervisors indicated that policy issues such as expanding high schools beyond 2,000 students would require the School Board�s consideration of public input before taking action at the policy level.

Chairman York requested that this item be placed on the Joint Board of Supervisors and School Board Committee meeting agenda for further discussion.

3. Structure and Terms of Board of Supervisors, Form of Government, and Reapportionment:

Tim Hemstreet, County Administrator, made a brief presentation regarding Structure and Terms of the Board of Supervisors, Form of Government and Reapportionment. He noted at the January 20, 2010 Business Meeting, an item initiated by Supervisor Waters was discussed regarding the topics of the structure and terms of the Board of Supervisors (including the idea of implementing staggered terms), the appropriate form of government for Loudoun County, and general guidelines for the redistricting process associated with the 2010 census.

Supervisor Delgaudio moved that the Board of Supervisors enter into a Committee of the Whole. (Seconded by Supervisor Waters. The motion FAILED 2-7, Supervisors Delgaudio and Waters voted yes.)

The Board agreed to forward this item to the September 8, 2010 Board Business Meeting for a Committee of the Whole discussion of the issue.

The Board also agreed not to continue further discussion of adding at-large members to the Board.

4. Administrative Items Report of June 2, 2010:

Supervisor Miller moved that the Board of Supervisors approve the Administrative Items Report of June 2, 2010. (Consent Item) (Seconded by Supervisor Burk. The motion passed 9-0.)

a. BUDGET ADJUSTMENTS:

The Board of Supervisors moved to (1) approve the FY10 budget adjustments as set out in the June 2, 2010 Administrative Items Report, (2) recognize an increase in revenue in the amount of $358,943 in the General Fund for FY10, and (3) make an increase in FY10 appropriations of $358,943 in the General Fund; BA-105807, BA-106232, BA-106299, BA-106300, BA-106301, BA-106340, BA-106427, BA-106462, BA-106465, BA-106469, and BA-106536.

PURCHASE OF REAL ESTATE FOR THE NEIGHBORHOOD STABILIZATION PROGRAM (NSP) GREENFIELD COURT, STERLING: The Board moved to approve and ratify the contract to purchase the property at 234 Greenfield Court in Sterling, and that the Chairman of the Board of Supervisors, the Vice Chair, the County Administrator or his designee be authorized to execute the Deed to the property as being accepted by the Board pursuant to Virginia Code �15.2-1803. Said deed shall be approved as to legal form by the County Attorney, who shall be authorized to execute any collateral documents required at settlement.

g. REALLOCATION OF CMAQ FUNDING TO DESIGN AND COMPLETE PRELIMINARY ENGINEERING ON CANOPY OR SIMILAR WEATHER PROTECTION FOR DULLES NORTH TRANSIT CENTER RIDER QUEUING AREA: The Board moved to request that NVTA reallocate $173,158 in CMAQ funds from the lease of Park and Ridge spaces for Leesburg to the design and preliminary engineering of a canopy structure, or similar weather protection for the Dulles North Transit Center rider waiting area.

The Board further moved that Tim Hemstreet, County Administrator, be authorized to make this request on behalf of the Loudoun County Board of Supervisors.

5. Proposed Amendment to Chapter 209 (Voting Precincts and Polling Places) of the Codified Ordinances of Loudoun County/Authorization to Advertise for Public Hearing :

Board: Supervisor Burk moved that the Board of Supervisors establish a Towing Board to make recommendations regarding adoption of an ordinance to regulate services rendered by towing/storage companies on the non-consensual towing of vehicles from private property and responding to requests for police tows and to advise the Board of Supervisors on the appropriate terms for contracts with the towing/storage companies. (Seconded by Supervisor Kurtz. This motion was withdrawn.)

The Board agreed to forward Instituting a Towing Advisory Board to the June 15, 2010 Board Business Meeting for further discussion.

9. Board Initiated Item: Restoring Salary Supplements

for Court Magistrates : Supervisor Burk moved that the Board of Supervisors restore salary supplements for Court Magistrates eligible to receive them under the Code of Virginia at a cost of $41,200. (Seconded by Supervisor Delgaudio. The motion passed 9-0.)

Monday night we had a number of young men recognized for having completed the required steps to be awarded the rank of Eagle Scout. This is a tremendous achievement and I congratulate them all for their dedication to their service projects and to this goal.

On Tuesday morning the Loudoun County Board of Supervisors honored outgoing Fire Chief Joe Pozzo with a resolution of appreciation. Chief Pozzo guided us through a difficult career staffing transition within fire and rescue and he is to be commended. I wish him the best of luck. There has been lots of exciting news coming out of our libraries in the last month. On April 23, 2010 the Virginia Public Library Directors Association selected Scott Stewart as Outstanding Library Trustee of the Year. It's a well-deserved honor. Congratulations Scott and thanks for all you do for LCPL! Additionally, the Loudoun County Public Library is now ranked 6th in the nation for libraries in the 250K to 500k populations. Lastly, a Loudoun County librarian will have the honor of helping to select one of the oldest and most prestigious awards in children�s literature. Tony Carmack, Children�s Librarian at the Ashburn Library, has been elected to the Caldecott Award Selection Committee, which chooses the recipient of the Caldecott Medal, awarded annually to the artist of the most distinguished American picture book for children. Carmack says his election is something many children�s librarians aspire to. This is something to really be proud of!

I would also like to recognize the 40th Anniversary of the Virginia Scenic Rivers Program in Virginia that was adopted by the Board of Supervisors in recognition of the Catoctin Creek and Goose Creek in Loudoun County designated as Virginia Scenic Rivers. The Virginia Scenic Rivers Program identifies, designates and helps protect rivers and streams that possess outstanding scenic, recreational, historic and natural characteristics of statewide significance for future generations.

Recycle your old computers, televisions, and other electronics at the next Loudoun County Electronics Collection Event this Saturday, May 8 from 9:00 a.m. to 2:00 p.m. at the Leesburg Park and Ride, 19730 Sycolin Road. Fees include: $20 per TV; $8 per computer monitor; and $1 each for all other accepted items (pay cash or check only). Limit 15 items per vehicle. In the next two months you will be hearing about the Countywide Transportation Plan (CTP). We are currently working on this and are at the end of what has been a five year process. Many people have contributed to this plan; staff, businesses and residents alike and I want to thank all of you who have contributed a multitude of hours to make this happen. We are almost there.

The Public Hearing for the Chesapeake Bay Preservation Act is May 24, at 6:30 pm. The Chesapeake Bay Preservation Act is a government program that sets guidelines and restrictions on 84 tidewater areas that flow in to the Chesapeake. Loudoun County lies within the Potomac Watershed which drains in to the Chesapeake Bay. If you would like to speak you may pre-register by calling Ann Stewart at 703-771-5072.

Finally, during the 2009 year, volunteers in Loudoun County who help with sports & youth programs, parks programs, Area Agency on Aging, community centers programs, and in other areas, contributed an estimated total of 783,117 hours of their time. UPDATE ON REDSKINS� MARKETING EFFORTS/DEPARTMENT OF ECONOMIC DEVELOPMENT : Buddy Rizer, Economic Development, and Scott Shepherd form the Washington Redskins, gave an update regarding the two-year marketing sponsorship of Restricted TOT funds to promote the Loudoun brand through the Washington Redskins.

PRESENTATION BY PABLO CUEVAS, ROCKINGHAM COUNTY CHAIRMAN:

Pablo Cuevas, Chairman of the Rockingham County Board of Supervisors, stated that earlier this year that he and Chairman York had a friendly wager on their County�s High School Basketball Teams Championship games. Loudoun County�s Freedom High School Girl�s and Potomac Falls Boys� Basketball teams won the championships and Chairman York won the wager. Chairman Cuevas presented Board members with gifts from Rockingham County .

- BRIEFING BY SHERIFF STEVE SIMPSON: Sheriff Steve Simpson briefed the Board on the Significant Incident Report.

- ADOPTION OF CONSENT AGENDA: Supervisor Waters moved that the Board of Supervisors adopt the consent agenda to include the following items: #1, #2, #5, #6, #7, #8, #9a, #10, #11 and #12. (Seconded by Supervisor McGimsey. The motion passed 9-0.)

- CLOSED SESSION

Vice Chairman Buckley moved that the Board of Supervisors recess this public meeting and enter into closed session. The authority for this closed session is

Section 2.2-3711(A) , Subsection (3), and the purpose of the closed session is the discussion and consideration of the acquisition of real property for public use, where discussion in open session would adversely affect the bargaining position or negotiating strategy of the Board. The subject is the acquisition of office buildings for County use.

In addition, the authority for this closed session is Section 2.2-3711 (A), Subsection 7, and the purpose of the closed session is consultation with legal counsel on pending legal matters. The subjects are:

1. The Limestone Overlay District lawsuits; and

2. Giordano et al v. Town of Leesburg (Leesburg utility rate litigation).

- TOWN OF LEESBURG V. GIORDANO: Supervisor Kurtz moved that the Board of Supervisors authorize the filing of a friend-of-the-court brief in support of the citizen-appellees in Town of Leesburg v. Giordano, in a form approved by the County Attorney. (Seconded by Supervisor Delgaudio.)

Supervisor Miller moved an amendment that the Board of Supervisors withdraw from the Virginia Municipal League (VML). (Seconded by Supervisor Delgaudio. The motion FAILED 3-6, Supervisors Delgaudio, Miller and Waters voted yes.)

3. Approval of Issuance of Solid Waste System Revenue Bonds :

Chairman York moved that the Board of Supervisors adopt the authorizing resolution entitled: RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF SOLID WASTE SYSTEM REVENUE BONDS BY THE COUNTY AND OTHER RELATED ACTIONS AND APPROVING THE EXECUTION AND DELIVERY OF RELATED DOCUMENTS IN CONNECTION WITH THE SALE OF BONDS BY THE VIRGINIA RESOURCES AUTHORITY TO FINANCE THE EXPANSION AND IMPROVEMENT OF SOLID WASTE FACILITIES, as provided in Attachment 4. 4. 2010 General Assembly Session Final Report : Jeff Gore and Roger Wiley of Hefty and Wiley, P.C., who serve as the County�s legislative liaisons, presented the final report on the 2010 General Assembly Session and pertinent information in preparation for the 2011 General Assembly Session or possible special sessions. The 2010 General Assembly Session was a �long session,� beginning on January 13. The session lasted 61 days ending on March 14. As in the past and throughout this year�s session, the Board received a series of legislative reports usually at each business meeting until the session officially ends.

5. FY2011-2016 Six Year Improvement Program/Board

Statement : Supervisor Waters moved that the Board of Supervisors endorse the statement regarding The FY2011-FY2016 Six-Year Improvement Program.

Supervisor Waters further moved that Supervisor Kelly Burk, Chairman of the Board of Supervisors� Transportation and Land Use Committee, be appointed to deliver this statement on behalf of the Board of Supervisors at the May 26, 2010 pre-allocation public hearing. 8. FY11 Virginia Department of Transportation State Revenue Sharing Program : Supervisor Waters moved that the Board of Supervisors approve the extension of Pacific Boulevard from Dresden Street to Relocation Road as the candidate project for the FY11 State Revenue Sharing Program funds. (Consent Item) (Seconded by Supervisor McGimsey. The motion passed 9-0. )

9a. Transportation and Land Use Committee Report/Board of Supervisors Delegation of Approval Authority to Act Upon Certain Pump and Haul Requests : Supervisor Waters moved that the Board of Supervisor approve the April 21, 2010 Transportation and Land Use Committee recommendation that the Board of Supervisors delegate approval authority to the County Administrator for Permanent Pump and Haul requests that meet both the Comprehensive Plan and the Loudoun County Health Department�s recommendation for approval.

Supervisor Waters further moved that staff be directed to prepare a resolution affirming such action to delegate this authority and said draft resolution be brought to the Board of Supervisors for action. (Consent Item) (Seconded by Supervisor McGimsey. The motion passed 9-0. )

9b. CMPT 2008-0020, SPEX 2008-0061 & SPEX 2008-0062/White�S Ford Park :

Supervisor Kurtz moved that the Board of Supervisors ratify the Planning Commission approval of CMPT 2008-0020, White�s Ford Park with the Memorandum of Understanding dated March 30, 2010 and the findings with the following modifications:

1) The right turn lane on northbound Route 15 to accommodate park visitors should be relocated from Limestone School Road to Spinks Ferry Road.

2) All documentation associated with the Commission Permit should be revised as necessary to be consistent with the Special Exception Conditions, including the relocation of the turn lane.

3) The Commission Permit should be ratified as a finding that the general location, extent and character of the public park use on subject property is in substantial accord with the Comprehensive Plan.

4) SPEX 2008-0061 and SPEX 2008-0062 reflect in the Conditions of Approval the relocation of the right turn lane from Route 15 on to Spinks Ferry Road.

5) The Memorandum of Understanding is to be revised to reflect the relocation of turn lane on Route 15 to Spinks Ferry Road and the final action on the special exception applications.

(Seconded by Supervisor Delgaudio. The motion passed 9-0.)

I am receiving many letters on the County Wide Transportation Plan (CTP) and I appreciate your input. The CTP was last revised in 2001. It has been an ongoing process since 2006, and I stress that for those that feel that perhaps we are rushing through this. The Planning Commission has work long and hard on this revision and I very much appreciate their time and dedication to the process and the end product.

I�m passing on information about the Virginia Energy Efficient Appliance Rebate Program that starts on April 28th. The rebate can be used for specific appliances and is limited to one rebate per household. You can reserve your Energy Efficient Appliance Rebate beginning April 28 at 11:00 a.m. To learn more about this rebate program click on this link: http://www.dmme.virginia.gov/arra.shtml . Once at the website, you will find many links so you can learn the specifics of this program and other programs both Federal & State that many help with tax credits that you can claim when you do your 2010 tax returns.

On Saturday, April 24, 2010, from 10 a.m. to 3 p.m. the 22nd Annual Loudoun Arbor Day Celebration will be held at Morven Park, 17263 Southern Planter Lane, just west of Leesburg. The family-friendly event will feature many opportunities for adults and children to learn about the countless benefits that are associated with trees. This year�s celebration will kick off with a parade at 11 a.m. followed by many activites.

Lastly, the Loudoun County Board of Supervisors has adopted a resolution in support of Earth Day and the local EarthDay@Loudoun event scheduled for Sunday, April 25, 2010, in Broadlands. The EarthDay@Loudoun Family Festival will be held April 25 from 11:00 a.m. to 4:00 p.m. at Willow Creek Farm, 42920 Broadlands Boulevard in Ashburn.

The festival promotes and celebrates environmental stewardship among county residents and businesses and encourages people to take steps such as recycling and energy conservation. Activities will include entertainment, exhibits, and workshops that engage and inspire the entire community, especially the next generation of environmental stewards. The festival is organized by the Broadlands Certified Community Wildlife Habitats Committee. More information is available online at www.earthdayatloudoun.org.

Listed below is a summary report of the Board�s action taken at its April 6, 2010 Business Meeting.

ADOPTION OF CONSENT AGENDA: Vice Chairman Buckley moved that the Board of Supervisors adopt the consent agenda, as amended, to include the following items : #2 (Item #2a-BA-105669 -Surplus School Capital Project Funds pulled), #5, #6, #8, #9, #10, #11, #12, #13, #14, #15, #16, and #17. (Seconded by Supervisor Burton. The motion passed 9-0.)

CLOSED SESSION: Vice Chairman Buckley moved that the Board of Supervisors recess this business meeting and enter into closed session. The authority for this closed session is Section 2.2-3711 (A) , Subsection (3), and the purpose of the closed session is the discussion in open session would adversely affect the bargaining position or negotiating strategy of the Board. The Board of Supervisors moved to approve and ratify the contract to purchase the property at 1400 Amelia Street, North, in Sterling and that the Chairman of the Board of Supervisors, the Vice Chair or the County Administrator be authorized to execute the Deed to the property as being accepted by the Board pursuant to Virginia Code �15.2-1803. Said deed shall be approved by the County Attorney, who shall be authorized to execute any collateral documents required at settlement.

g. CORRECTION/ZMOD 2008-0013 � SAFEWAY AT STERLING PLAZA COMPREHENSIVE SIGN PACKAGE

The Board of Supervisors moved to approve revised Condition #1, which references the Sign Package dated December 29, 2009.

h. AUTHORIZATION FOR COUNTY ADMINISTRATOR TO SIGN VDOT STANDARD PARTNERSHIP ADMINISTRATION AGREEMENT (SPAA) FOR LEASE OF COMMUTER PARKING SPACES IN BROADLANDS SOUTH, IN SUPPORT OF THE TYSONS EXPRESS SERVICE

The Board of Supervisors moved to authorize the County Administrator to execute the Standard Partnership Administration Agreement (SPAA) for the lease of Park and Ride spaces in Broadlands South, in support of the Tysons Express Service.

3. LEGISLATIVE ISSUES FOR 2010 GENERAL ASSEMBLY

(This item was discussed at the Board of Supervisors� Public Input and General Business Meeting held April 5, 2010.)

4. ADOPTION OF THE FY 2011 TAX RATES, OPERATING AND CAPITAL BUDGET, AND APPROPRIATIONS RESOLUTION

Chairman York moved that the Board of Supervisors adopt the FY2011 Fiscal Plan, as presented by the County Administrator on February 8, 2010, and amended by the Board of Supervisors at the March 3, 10, 16, 18, 22 and 25, 2010 budget worksessions, a summary of which is included as Attachment A. (Seconded by Supervisor Miller.)

Supervisor Burton moved to amend the motion that the Board of Supervisors reinstate the Environmental Health Program Manager described on Page E-55 at a cost of $107,000. (Seconded by Supervisor Kurtz. The motion passed 5-4, Buckley, Delgaudio, Waters and York voted no.)

Supervisor Burk moved to amend the motion that the Board of Supervisors reinstate funding of $55,645 to reinstitute the Extension Service Financial Counseling Coordinator position of (1) FTE equivalent. (Seconded by Supervisor Kurtz. The motion passed 5-4, Supervisors Buckley, Delgaudio, Miller and Waters voted no.)

Supervisor McGimsey moved to amend the motion that the Board of Supervisors add $128,949 to the Health and Welfare Regional Organizations in order to maintain FY10 levels of funding for existing non-contractual health and human service nonprofit listed on Pages 3-93 through 3-99 with the exception of Interfaith Relief, Loudoun ENDependence, and Northern Virginia Family Services which would maintain their approved increase in funding. (Seconded by Supervisor Burk. The motion passed 6-3, Supervisors Buckley, Delgaudio and Waters voted no.)

Supervisor McGimsey moved to amend the motion that the Board of Supervisors fund $15,000 to Friends of Loudoun Mental Health. (Seconded by Supervisor Miller. The motion passed 7-2, Supervisors Buckley and Waters voted no.)

Supervisor Delgaudio moved to amend the motion that the Board of Supervisors approve the following friendly amendments:

- Reduce the expenditure for Regional Organizations taking out $191,000 from the Metropolitan Washington Council of Governments; $385,112 from the Northern Virginia Community College; $908,063 from the Northern Virginia Regional Park Authority; $134,000 from the Northern Virginia Regional Commission; and $65,000 from the Loudoun Small Business Development Center.

- Reduce the expenditure across all Departments of tax dollars for the Drug Court by $296,000.

- Reduce the Sheriff�s Office of tax dollars and return to the balance of $569,000 to eliminate the DARE Program.

- Reduce 7.49 full-time equivalents (FTE�s) {which is referenced in the Proposed FY10 Fiscal Plan Tier 3}.

- Reduce by $900,000 from the Board of Supervisors� District budget, but to leave a balance of approximately $200,000 of the $1.2 million for supervisor payroll and audit costs.

- Reduce one additional FTE from Management and Financial Services to achieve a savings of $100,000.

- Reduce one additional FTE from Building and Development to achieve a savings of $100,000.

- Reduce expenditures by $300,000 for one day closings of all libraries, parks, community centers, and senior centers to achieve this in an equitable manner.

- Revoking all tax exemptions in this fiscal budget in the amount of $4,984,809 for Air Force Retired Officers� Community, the American Water Resources, the Friends of the Homeless Animals, the Alexander Home for Animals, the Howard Hughes Medical Institute, the Jack Kent Cooke Foundation, the Prison Fellowship, and the Virginia Regional Transportation Association. (Supervisor Delgaudio�s amendment to the motion died due to lack of a second.)

Chairman York�s motion that the Board of Supervisors adopt the FY2011 Fiscal Plan, as amended, passed 5-4, Supervisors Buckley, Burk, Delgaudio, and Waters voted no.

Chairman York moved that the Board of Supervisors approve the tax rates as displayed in Attachment B. (Seconded by Supervisor Burton.)

Supervisor Delgaudio moved to amend the motion that the Board of Supervisors approve an increase in the tax rate from $.01 to $.02 for Public Utility Personal Property (Aircraft Only); for Aircraft/Flight Simulators $.01 rate to $.02 rate and for Satellite Manufacturing Equipment as from $.01 to $.02 rate. (Supervisor Delgaudio�s amendment to the motion died to a lack of a second.)

Supervisor Burton moved to separate the motion on Personal Property-Clean Special Fuels Vehicles (Attachment B).

Voting on the Motion for Personal Property-Clean Special Fuels Vehicles for $4.20 per $100 passed 7-2, Supervisors Burton and McGimsey voted no.

Chairman York�s motion to approve the tax rates as displayed in Attachment B passed 6-3, Supervisors Buckley, Delgaudio and Waters voted no.

Chairman York moved that the Board of Supervisors adopt FY2011 Appropriations Resolution as found on Attachment C. (Seconded by Supervisor Miller. The motion passed 6-3, Supervisors Buckley, Delgaudio and Waters voted no.)

Chairman York moved that the Board of Supervisors adopt the FY2011-2016 Capital Improvement Program, as amended by the Board of Supervisors at the March 25, 2010 budget worksession found on Attachment D. (Seconded by Supervisor Burk.)

Supervisor Waters moved to separate the motion concerning the HS-8/Ashburn Area noted on Attachment D, Page 11.

Voting on the Motion on HS-8/Ashburn Area on Attachment D, Page 11 passed 7-2, Supervisors Burton and Waters voted no.

Chairman York�s motion to adopt the FY2011-2016 Capital Improvement Program, as amended by the Board of Supervisors at the March 25, 2010 budget worksession found on Attachment D, passed 7-2, Supervisors Delgaudio and Burton voted no.

5. INDUSTRIAL DEVELOPMENT AUTHORITY BOND ISSUANCE FOR THE HILL SCHOOL CORPORATION OF MIDDLEBURG AND HILL SCHOOL PROPERTIES

Vice Chairman Buckley moved that the Board of Supervisors adopt the Resolution of the Board of Supervisors of the County of Loudoun, Virginia for Issuance of Bonds by the Industrial Development Authority of Loudoun County, Virginia to Assist the Hill School Corporation of Middleburg in a Total Amount Not to Exceed $13,000,000 as provided in Attachment 1. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0.)

6. REVIEW AND RENEWAL, MODIFICATION OF TERMINATION OF THE NEW OAK HILL AGRICULTURAL AND FORESTAL DISTRICT

Vice Chairman Buckley moved that the Board of Supervisors adopt the ordinance and renew the New Oak Hill Agricultural and Forestal District for a term of four years and require any subdivisions or adjustments to parcels in the district to meet the current zoning requirements or a minimum of 40 acres, whichever is greater. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0. )

7. ZMAP 2006-0011/ZCPA 2006-0003/STONE RIDGE COMMERCIAL

Supervisor Miller moved that the Board of Supervisors approve ZMAP 2006-0011 and ZCPA 2006-0003, Stone Ridge Commercial, subject to the Proffer Statement dated February 22, 2010, revised to March 25, 2010, and with the Findings for Approval. (Seconded by Supervisor Waters. This motion did not receive a vote.)

TITUS: Supervisor Miller moved that the Board of Supervisors endorse and adopt Virginia General Assembly Resolution Number 170, �Celebrating the Life of George William Titus,� and present this resolution with State Senator Mark Herring to the Titus Family at the Board�s General Business Meeting on Monday, May 3, 2010. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0. ) This item was initiated by Chairman York.

5. BOARD MEMBER INITIATIVE: COUNTY APPOINTEES PARTICIPATING IN CIVIC ASSOCIATIONS: Supervisor Miller moved that the Board of Supervisors direct the County Attorney to render a written opinion as to whether or not participation by more than two appointees to a given County board, agency, commission, or other body prohibits participation in civic associations that meet to discuss public business when the meetings of those associations are not convened in accordance with the Virginia Freedom of Information Act. (Seconded by Supervisor Burton. This motion did not receive a vote.)

Supervisor Delgaudio moved an amendment to the motion to include �any two Board of Supervisors� participation. (This motion died due to lack of a second.)

Supervisor Delgaudio moved an amendment to include Board of Supervisors� membership on regional commissions and bodies. (This motion died due to a lack of a second.)

Vice Chairman Buckley moved a substitute motion that the Board of Supervisors direct the County Attorney to prepare a memo which presumes a legal opinion as the basis of that memo to distribute to all members appointed to County boards and commissions; that the memo detail the requirements of FOIA; and set forth the nature of discussions and activities as a result of the appointees� membership in civic associations that may or may not violate FOIA. (Seconded by Supervisor Waters.)

Vice Chairman Buckley accepted Supervisor Waters� friendly amendment that the Board of Supervisors direct Jack Roberts, County Attorney, to hold one or two sessions in the Board Room to educate the appointees on this issue and other related FOIA issues.

Vice Chairman Buckley�s motion, as amended, passed 5-4, Supervisors Burton, Kurtz, McGimsey and Miller voted no.

6. BOARD MEMBER INITIATIVE: LOUDOUN VALLEY ESTATES III REZONING FROM PD-G1 TO R-1 : Supervisor Miller moved that the Board of Supervisors direct staff to process a rezoning of Loudoun Valley Estates III from PD-G1, Planned Development General Industrial District to the R-1 Single Family Residential District. (Seconded by Chairman York. The motion passed 9-0.)

7. BOARD MEMBER INITIATIVE: BELLE TERRA HOA PEDESTRIAN PATHWAY: Supervisor Miller moved that the Board of Supervisors direct staff to review the proposal from the Belle Terra Homeowners Association to determine project costs and to review the ability of applying available proffer funds for a pedestrian pathway along Ryan Road. Staff is directed to provide the results to the Transportation and Land Use Committee. (Seconded by Chairman York. The motion passed 9-0.)

8. BOARD MEMBER INITIATIVE: RESOLUTION COMMEMORATING THE 40TH ANNIVERSARY OF THE VIRGINIA SCENIC RIVERS PROGRAM IN 2010: Supervisor Miller moved that the Board of Supervisors approve the resolution commemorating the 40th anniversary of the Virginia Scenic Rivers Program. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0.) This item was initiated by Supervisor Sally Kurtz.

9. ROLE OF THE COURTHOUSE GROUNDS AND FACILITIES COMMITTEE: Chairman York moved that the Board of Supervisors forward this item to the Finance /Government Services and Operations Committee meeting for further discussion. (Seconded by Supervisor Delgaudio.)

Chairman York accepted Supervisor Miller�s friendly amendment that the Board of Supervisors schedule a Committee of the Whole discussion at a future Board meeting.

Chairman York asked that County staff have a discussion with representatives from the Courthouse Grounds and Facilities Committee regarding potential issues for the month of December.

Supervisor McGimsey asked that the issue of re-enactors using the Courthouse grounds and facilities during Court Days in October be included in the discussion during the Committee of the Whole.

Chairman York requested that Jack Roberts, County Attorney, research what is being done by the National Park Service with respect to the display issue on the National Mall.

The motion to forward to a Committee of the Whole discussion passed 9-0.

10. ZMAP 2009-0005, SPEX 2009-0009 & CMPT 2009-0001/GREEN ENERGY PARTNERS/STONEWALL HYBRID PARK: Supervisor Kurtz moved that the Board of Supervisors ratify CMPT 2009-0001, Green Energy Partners/Stonewall Hybrid Energy Park, and approve ZMAP 2009-0005 and SPEX 2009-0009, Green Energy Partners/Stonewall Hybrid Energy Park, subject to the April 19, 2010 Proffer Statement and the April 5, 2010 Conditions of Approval and based on the Findings for Approval. (Seconded by Supervisor Miller.)

Supervisor Burk moved that the Board of Supervisors enter into a Committee of the Whole for discussion. (Seconded by Supervisor Kurtz. The motion FAILED 3-6, Supervisors Buckley, Burton, Delgaudio, Miller, Waters and York voted no.)

Supervisor Kurtz�s motion passed 9-0.

11. ZOAM 2007-0004/FARM MARKETS IN VARIOUS ZONING DISTRICTS AND REDUCE MINIMUM ACREAGE REQUIREMENTS FOR AGRICULTURE, HORTICULTURE, AND ANIMAL HUSBANDRY USES:

Chairman York moved that the Board of Supervisors approve ZOAM 2007-0004 regarding permitting Farm Markets (off-site production) in various zoning districts and to reduce the minimum acreage required to establish Agriculture, Horticulture and Animal Husbandry uses, as contained in Attachment 2.

Chairman York further moved that the Board of Supervisors find that this Amendment is required by the public necessity, convenience, general welfare and good zoning practice. (Seconded by Supervisor Burton. The motion passed 9-0.)

12. RURAL RECREATIONAL ESTABLISHMENT, OUTDOOR � RESOLUTION OF INTENT TO AMEND THE ZONING ORDINANCE:

Supervisor Miller moved that the Board of Supervisors adopt the Resolution of Intent to Amend the Zoning Ordinance in Attachment 1 to change the Use Type �Rural Recreational Establishment, Outdoor� from being a use permitted as a matter of right (permitted use) to a use that is allowed as a minor special exception use in the Agricultural Rural-1 (AR-1), Agricultural Rural-2 (AR-2), Joint Land Management Area-20 (JLMA-20), and Transitional Residential-10 (TR-10) zoning districts and to establish new Additional Regulations for the �Rural Recreational Establishment, Outdoor� use. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0.)

13. JOINT BOARD OF SUPERVISORS AND SCHOOL BOARD COMMITTEE REPORT / LOUDOUN COUNTY PUBLIC SCHOOLS CAPITAL FACILITIES PLANNING GUIDELINES: Supervisor Kurtz moved that the Board of Supervisors approve the recommendation by the Joint Board of Supervisors and School Board Committee to adopt the Loudoun County Public Schools� Capital Facilities Planning Guidelines. (Seconded by Vice Chairman Buckley. The motion passed 8-1, Supervisor Miller voted no.)

14a. FINANCE/GOVERNMENT SERVICES AND OPERATIONS COMMITTEE REPORT / CONTRACT RENEWAL/OPERATION AND MAINTENANCE OF THE COMMUTER BUS SYSTEM: Supervisor Miller moved that the Board of Supervisors approve the recommendation by the Finance/Government Services and Operations Committee to authorize the Purchasing Agent to renew the Operation and Maintenance of the Commuter Bus System contract with VEOLIA Transportation Services, Inc. in the estimated amount of $20,356,296. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0. )

14b. FINANCE/GOVERNMENT SERVICES AND OPERATIONS COMMITTEE REPORT / CONTRACT AWARD/CONSTRUCTION OF THE LEACHATE SYSTEM PUMP STATIONS, FORCED MAIN AND SCADA SYSTEM : Supervisor Miller moved that the Board of Supervisors approve the recommendation by the Finance/Government Services and Operations Committee to authorize the Purchasing Agent to award a contract for the Construction of the Leachate System Pump Stations, Forced Main, and SCADA System to Mid-State Construction Company in the amount of $648,000. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0.)

14c. FINANCE/GOVERNMENT SERVICES AND OPERATIONS COMMITTEE REPORT / AWARD AUTHORITY INCREASE/ARCHITECTURAL AND ENGINEERING SERVICES FOR THE LEESBURG PARK-AND-RIDE FACILITY: Supervisor Miller moved that the Board of Supervisors approve the recommendation by the Finance/Government Services and Operations Committee to authorize the Purchasing Agent to increase the award authority for the Architectural and Engineering Services for the Leesburg Park-and-Ride Facility contract by $12,177 for a new contract total of $510,560. (Consent Item) (Seconded by Supervisor Burton. The motion passed 9-0. )

15. ASHBURN AREA SCHOOLS � SITE ASSESSMENT STUDIES

Supervisor Waters moved that the Board of Supervisors proceed with the County/School Board owned site assessments identified in this item for the Ashburn area schools.

Supervisor Waters further moved that the Board of Supervisors approve Budget Adjustment #105796, which transfers $485,000 from the County Land Acquisition capital project to the School Capital Fund. (Seconded by Supervisor Miller. The motion passed 8-1, Supervisor Burton voted no.)

16. APPL 2010/0003/ZEBRA VENTURES LLC

Supervisor Miller moved that the Board of Supervisors uphold and wholly affirm the December 15, 2009 proffer determination issued by the Zoning Administrator. (Seconded by Supervisor McGimsey. The motion passed 8-1, Chairman York voted no. )

AMENDMENT:

17. Resolution of Endorsement to the National Capital Region Land Conservation Act : Supervisor McGimsey moved that the Board of Supervisors suspend the rules. (Seconded by Supervisor Kurtz. The motion passed 9-0.)

Supervisor McGimsey moved that the Board of Supervisors adopt a resolution endorsing the National Capital Region Land Conservation Act.

Supervisor McGimsey further moved that the Chairman be authorized to sign the resolution on the Board's behalf. (Seconded by Supervisor Burk. The motion passed 6-3, Supervisors Delgaudio, Waters and York voted no. )

Authorization for the School Board to Proceed with Engineering Assessments for Evaluation of Land Sites for Western Loudoun School Sites High School-10, Middle School-10 and Elementary School-10: Supervisor Kurtz moved that the Board of Supervisors authorize the School Board to proceed with engineering assessments to evaluate land sites purchased for Western Loudoun School Sites, High School-10, Middle School-10, and Elementary School-10.

Supervisor Kurtz further moved approval of Budget Adjustment #105791 which transfers $372,000 from the HS-10 County Land Acquisition capital project account to the HS-10 School capital project account to conduct land site assessments for HS-10. (Seconded by Supervisor Burton. The motion passed 9-0.)

Authorization for the Loudoun County School Board to Proceed with Land Site Evaluations in Ashburn Area:Supervisor Waters moved that the Board of Supervisors authorize the Loudoun County School Board to proceed with land site evaluations in the Ashburn area for schools.

Supervisor Waters further moved approval of Budget Adjustment #105797 which transfers $109,000 in state lottery proceeds from the County Land Acquisition capital project to the School Capital Fund. (Seconded by Supervisor Kurtz. The motion passed 8-1, Supervisor Burton voted no.)

CLOSED SESSION (II): Vice Chairman Buckley moved that the Board of Supervisors recess this business meeting and enter into closed session. The authority for this closed session is Section 2.2-3711(A) , Subsection (7), and the purpose of the closed session is consultation with legal counsel on pending legal matters. The subjects are:

1. The Limestone Overlay District lawsuits; and

2. Giordano et al v. Town of Leesburg (Leesburg water rates litigation).

(Seconded by Supervisor McGimsey. The motion passed 9-0.)

Chairman York moved that the Board of Supervisors adjourn the closed session and that the Board of Supervisors reconvene its business meeting and that the minutes of the business meeting should reflect that no formal action was taken in the closed session. (Seconded by Supervisor Waters. The motion passed 8-0-1, Vice Chairman Buckley absent for the vote.)
